For Second Time, Hart Probate Judge Case Fails to Go Before Grand Jury

Northern Judicial District Attorney Parks White once again did not present his case against former Hart County Probate Judge Bob Smith when the Hart County Grand Jury met last week.

The Grand Jury met primarily to interview the four candidates for the new Hart County Board of Elections.

However, it was expected White might also bring up the Smith case to the Grand Jury.

Smith was arrested in May and charged with one count of misdemeanor simple battery and one count of misdemeanor attempt to commit sexual battery after a woman who came to him for help with a parking told authorities Smith allegedly fondled and kissed her against her will.

Smith left office in late July, taking medical leave.  His last official day is tomorrow, September 30th.

In August, White did not present his case as expected because he said agents with the GBI had not finished their investigation, but WLHR News has learned that investigation has concluded and the results turned over to the DA’s office.

White so far, has not commented on the Smith case.

The next Grand Jury is not expected to convene until possibly February of 2015.
