Elberton Man Sentenced to 50 Years in Shooting

Tyson Dantrail Evans3In Elbert County, a two-day trial ended Thursday with the conviction of an Elberton man in the shooting of another man last fall.

Northern Circuit District Attorney Parks White said a jury convicted Tyson Dantrail Evans, 26, on multiple counts, including aggravated assault, aggravated battery, discharging a firearm during the commission of a crime, possession of a firearm by a convicted felon and discharging a firearm on the property of another.

White said on October 14, 2012, Evans shot Albert Dye at a park on Almond St. in Elberton.  Dye was treated at a local hospital for injuries to his liver, lungs, and ribs.

After the shooting, Evans then fled the state, but was captured in December by investigators with the U.S. Marshal’s office.  White said Evans is a career criminal and he asked Superior Court Judge John Bailey to sentence Evans on that basis.

“He had four prior felony convictions in 2005; two convictions for terroristic threats, a conviction for aggravated battery, and a conviction for aggravated assault,” White said. “We noticed him as a recidivist under Georgia’s recidivist statute and refused to waive recidivist notice.”

White said on that basis, Judge Bailey sentenced Evans to 50 years with 45 years to serve.

According to Georgia Department of Corrections records, Evans had just been released from prison in August of 2012 after serving time for the 2005 aggravated assault conviction when he shot Dye.

According to White, the jury took just fourteen minutes to find Evans guilty on all counts.
