Sweet City Loses Battle For Landfill in Elbert County

The Georgia Supreme Court hands a win to Elbert County Government in its long running legal battle with a group of landfill developers.
Sweet City Landfill LLC, wants to operate a 270-acre landfill on one of three potential sites in Elbert County.  In 2012, the Elbert County Board of Commissioners voted not to enter into a host agreement with Sweet City Landfill, LLC.
Sweet City sued and in March, the case went to the Supreme Court.  The high court struck down a lower court ruling that would have forced the commissioners to issue a landfill permit, even though, no commission action was taken on the application for the permit.
Sweet City Landfill must now go before the commission for a vote on the previous permit, which would be subject to a public hearing before any commission decision.
