Sleeping Man at Toccoa McDonald’s Charged with Drug Possession

In Toccoa, a man sleeping at the McDonald’s on Big A Road, found himself spending the night in jail.

According to Toccoa Police Chief Jimmy Mize, on the morning of September 18, officers were dispatched to McDonalds, on Big A Road, in regard to a sleeping male.

The caller stated when employees went to wake the man up, they saw drugs in the suspect’s backpack.

Upon arrival, the officers identified the suspect as 45-year-old Brian Lavestor Murphy.

After confronting Murphy about the possible drugs, he consented to a search of his backpacks and person.

The backpacks contained a gallon bag of what was believed to be marijuana, another zip-lock bag with several individuals bags of a white powder substance believed to be Cocaine, Marijuana “Shake” (small pieces), small blue baggies with white residue believed to be cocaine, and a box of zip-lock bags.

Murphy was transported to the police department interview room where the Toccoa Police Department Drug Agent was waiting.

On the way to the Police Department, Murphy pulled more Cocaine from somewhere on his person and tried to grind it into the floorboard of the patrol car.

He is charged with possession of cocaine with intent to distribute, possession of marijuana with intent to distribute, and destroying and tampering with evidence.

He remains in the Stephens County Jail.
